Karizmatik Kreationz, “K3” Bakery Policies

We look forward to providing you with the “Karizmatik” experience and thank you for allowing us to bake for you! Every client wishing to do business with us, is now REQUIRED to have a subscription to enjoy our services and prevent fraudulent transactions and abuse. Subscriptions
Subscriptions/retainers are required to conduct business with ‘K3” before any services are rendered. (i.e., custom cakes, cupcakes, treats, delivery of our products. etc).
A credit card authorization form is required for all members. Valid credit cards are considered to be major credit cards of Visa, Mastercard, and AMEX. Prepaid and cash app cards will not be valid.

Policies to order:
You MUST agree to the terms outlined below before ordering, please read them and select your answer below:
​
1. Your initial $50 deposit reserves your event date ONLY and serves as your cancellation fee and is NON-REFUNDABLE
​
2. We must receive the balance by the due date indicated or contract is null and void, and deposit will not be refunded.
​
3. The date of your final payment is the final date for any changes to delivery or pick-up times and/or requests. Any changes requested after this date cannot be guaranteed and may be subject to additional charges.

4. Delivery and setup is reserved specifically for the time you requested and can be included with your order total or paid COD.
​
5. We are not responsible for any damage to the cake after setup is complete. You are responsible for providing an appropriate and secure table/stand and environment for the cake(s). Cakes are heavy and require a sturdy table, and optimal room temperature of 70 degrees or below.

7. If you or your representative elect to pick up and set up the cake, you assume all liability and responsibility for the condition of the cake once it leaves our premises/possession.
​
8. On occasion we will photograph our cakes and we reserve the right to use any photographs for display or promotion without compensation to you.
​
9. Our products may contain or come into contact with milk, wheat, nuts, soy, and other allergens. You agree to notify your guests of this risk and hold us harmless for allergic reactions.

10. Performance of this agreement is contingent upon the ability of "Karizmatik Konfectionery" to complete the agreement with total cooperation and comprehension from you, our customer, and is subject to labor disputes or strikes, accidents, Acts of God, and other causes beyond our control.

11. You agree to the payment polices, terms and procedures as outlined via your full cake contract. A security deposit is required 24 hours after completing this form, balance is due in full 7 days before your cake due date & missing payment due dates will incur late fees.

Disclaimer:
We do not place candles or sparklers on any of our cakes as they have been known to cause allergies and sickness. You agree to hold ‘K3’, Karizmatik Konfectionery Kreationz, and the owner, harmless of any such incident.
All site items and custom orders are provided to you in likeness of the ideas, videos, or photographs that you send to us. WE DO NOT DO OR PROMISE EXACTNESS of any ideas, video or photographs that are sent to us, not even our own. Although we do like to come very close.
Retainer/Security Deposit:
A retainer of $50 is required on ALL CUSTOM ORDERS* and is non-refundable. Security deposits are required on all custom orders 24 hours after placing an order with the business and shall be ½ of the order total or more, at the discretion of the owner/managing member of the business.
Rush Orders
(Orders needed before 14 days notice, not including Sundays) are NOT eligible for security deposits; must be paid in full and are subject to an additional “rush/express” fee based on the size of your cake & number of days needed before the minimum advance notice ($7/day). Bakery Allergen Disclaimer/Covid 19
We do not specialize in allergen-free cakes, nor are we an allergen-free bakery. We do recognize that people contain severe and life- threatening allergies; some more acute and we always do our best to keep baking areas/miscellaneous areas clean and sanitized, however your cake may come into contact with trace elements of certain allergens and we are not responsible for any allergic reactions, illnesses or hospitalizations that may be claimed to have occurred when ordering our services or products. We do require staff and other contact members under our supervision, to take a Covid-19 test to ensure that we maintain covid free environment, and ask that you refrain from requesting our services if you are, or may think you are, positive with covid.

(Please Note: Payments of an inaccurate amount will be refunded to be repaid with the accurate amount including the applicable taxes and service fee.)
Payment Terms and Conditions
You agree to pay the remaining balance in full 7 days, 1 week (Including Sundays) before your custom order due date, unless otherwise specified. Unpaid or overdue invoices may result in late fees, and suspension or termination of the Project. Missing your due date payments will incur late charges of ($5) per day, every day for 4 days and by that time, the cake will be sold, etc.
Website Orders/Items
Although our site items are custom, and tailored to fit your needs, they are not considered like our new custom orders that require lengthy time to plan and execute, therefore they are not eligible for minimum security deposits, or payment plans, and require full payment at the time of ordering on our site.

Qualifying Payments
Acceptable/qualified payments for custom orders must be paid on/before the end of our processing day (5 PM)
No refunds
No refunds will be given on services completed as described in the contract are not subject to refunds. The Client will not be reimbursed for services canceled once work has begun. All sales are final.
Rush/Express Order Payment Terms

Cake Delivery
Yes, we deliver! We are not responsible for inclement weather and will not deliver in such conditions. We are not responsible for humidity/sun exposure and are equipped with air conditioned vehicles.

Delivery Times & Schedule
Sun-Tuesday: 11 AM-8 PM
Wed-Sat: 11 AM-1 PM
(Last delivery is (8PM); VIP (9 PM). (For example, level 1 & 2 Pastry Pals, if you need your cake for your event at 9pm, please choose a time of around 7PM.)
Delivery Fees, T&R
Up to the first 10 miles are only $30.00 and incur an additional fee per mile (fee per mile varies according to subscription level), for every mile after. We ask that YOU (our contact, the person who ordered the cake) or an authorized representative on your account, be available at the time of delivery to ensure that your order is to your expectations, and to sign the necessary paperwork upon delivery. The “Completion of Services” contract is REQUIRED to be signed before our delivery drivers leave your order and/or the premises, or the order will not be left with you.
Delivery Payments/Invoice
Payment can be included with your cake total; can be paid ON or BEFORE delivery and is also acceptable in cash upon delivery. Drivers do not carry ANY cash on their person, or inside of their vehicles, so we ask that you try and have exact change. MUST BE PAID at the time of delivery if not already paid*

(*If management decides to allow extra time for delivery to be paid, you (the client) will be asked to sign a promissory note agreeing to pay by a certain due date and abiding by the terms set forth as consequences for failure to do so. LEGAL ACTION WILL BE TAKEN!)
Cake Pick-Up
We ABSOLUTELY don’t mind you picking your cake up yourself! We like to think of it as your bonding moment actually but here are a few tips to deliver like a pro: Refer to your “Cake Care Card”
Please be on time for your cake pickup which all have a 10 minute grace period, or you will lose your spot/time and be charged a late pickup fee of $1 per/min, up to 50 additional minutes. The late fee will be required to be paid in full before you receive your order.

1. Please have someone (if possible) accompany you so that you or them will be able to HOLD the cake*(this applies to standing, and 2 tier or larger cakes)
​
2. Please have an air conditioned automobile and keep your windows rolled up to keep the cake cool from Houston's weather and elements. (i.e., the sun, humidity, rain and or snow).
​
3. DO NOT sit anything on top of your cake box, or sit your cake box on top of anything other than an individual’s lap, or the car’s seat. (When using only your car’s seat, please use the seat belt for the remainder of the transport).
​
4. WE KNOW it is impossible to avoid potholes and speed bumps, but we do recommend that you travel at a safe speed of 45-50 mph or under when transporting your own cake. (2 tier or larger)
​
5. Please AVOID hard braking (if possible) to avoid cake shifting, tipping or falling completely over.
​
6. DO NOT sit on your vehicle's floor for any reason!!!
WE WILL NOT REFUND ANY MONIES PAID AFTER PICKING UP YOUR OWN CAKE, OR BE HELD RESPONSIBLE FOR ANY DAMAGES THAT OCCUR AFTER THE CAKE LEAVES OUR PREMISES!
Outdoor Cake Display
For events held outdoors, we will not be held liable/responsible for damages that occur to your cake due to inclement weather, such as high winds, temperature, rain, snow, etc. We will not be held accountable for other outside elements such as uneven setups/displays, bugs or insects and/or debris (i.e, dust, trash or other minute matter). WE WILL NOT REFUND ANY PORTION OF YOUR MONIES AFTER DELIVERY IS MADE AND WE HAVE LEFT THE PREMISES!
Custom Cake Flavors, Dark Colors and Special Requests
We are always glad to bake whatever it is you want, (within our skill set) just to make you happy. However we will not be held liable for disputes or any concerns for products requested that are not a part of our menu, or outside our recommended guidelines. Darker icings, frostings and fondants may cause staining to clothes, mouth and teeth, and are not liable for such effects.
Cake Policy
All cakes must be cancelled one week in advance to receive a partial refund. Failure to cancel within this time frame ensures that the customer will only receive 50% of the refund. NO CASH REFUNDS ARE GIVEN. Failure to cancel within 3days of cake pick-up or delivery date and time will result in no refund given.

There will be a $10.00 fee to any changes made to cake orders within 24 hours.
We are not responsible for any damages done to cakes that leave our bakery when we are not delivering them.
